DIVORCE
The decision to divorce can be very difficult. The end of the marital relationship can equate to a complete life change and the process of involving the court in such a personal experience can be highly stressful for everyone involved. During these times, you need an experienced attorney to advise you and to help you through the process ahead.
Many complex issues must be addressed during the process of divorce, including child custody, child support, alimony, the division of debt and the allocation of assets. When you are going through the stress of a divorce, you need a reliable and attentive Attorney on your side to guide you through these matters.
Attorney Hanyard works hard to obtain the best possible results for her clients. Whether your matter proceeds to litigation or should you choose to settle the issues through standard negotiation or mediation, our focus is on finding the best resolution for you.
- CHILD CUSTODY/ PARENTING TIME
There is nothing more important to a caring parent than his or her children. When questions of child custody are at issue, emotions naturally run high. During these times, having an experienced and understanding lawyer can make all the difference.
Most child custody, visitation and parenting time arrangements are best resolved between the parties, thereby allowing them to make their own decisions regarding their children. Additionally, mutual agreements reached outside the courtroom have a greater potential for lasting success and are often more affordable. When child custody cases cannot be amicably resolved between the parties, a judge will consider a variety of factors, depending upon the evidence that the parties present.
Attorney Hanyard can help you work through the many issues involved in child custody, visitation or parenting time disputes. We will work to develop a fair and reasonable arrangement for you and your children.
- CHILD ADOPTION
There is no area of the law more fulfilling than the area of Adoption. Assisting in the process of uniting a child who is in need of a loving and safe home with caring people who will love and raise them, is an experience beyond compare for all involved.
Adoption is a legal process that results in a court order declaring one person (generally a minor) to be the legal child of the adoptive parent or parents. When an adoption is finalized, the birth parents have no legal rights to the child, are no longer responsible for the child and no longer have an obligation to support the child. Georgia law provides that any adult person 25 years old or older or an adult married couple may adopt a child. The prospective adoptive
parents must be at least 10 years older than the child. Each adoptive parent must be a resident of Georgia, except for an adult adoption in which the adult to be adopted can satisfy this requirement.
We are pleased to be able to help prospective adoptive parents, grandparents, single parents and step-parents through the process of adoption. If you have decided to adopt a child in the State of Georgia and are in need of legal representation to complete the process, please do not hesitate to contact our office.
- GRANDPARENT RIGHTS
The State of Georgia recognizes the value of the relationship between grandparents and their grandchildren. In the state of Georgia, grandparents have the right to seek visitation of their grandchildren when it is otherwise unavailable to them and can file a separate action, in certain circumstances, to seek visitation rights. We are strong advocates for the rights of grandparents and welcome the opportunity to consult with you regarding your existing, or potential, case.
- CHILD SUPPORT
Georgia law imposes a duty on each parent to provide financial support for their minor children. This is true whether a child is born while the parents are married or if the child is born out of wedlock. Georgia Child Support obligations are calculated by using an "income shares" formula which takes various factors into consideration.
Child Support is a right belonging to the child and no parent should be allowed to shun the responsibility of paying. The cost of day care, clothing, medical care, extracurricular activities and general day to day expenses can be extremely high. If one parent fails in their financial obligation, the child suffers.
Get the help that you and your family deserve. Attorney Hanyard has handled numerous child support matters, including the establishment of initial child support orders, modification (either upward or downward) of existing child support orders and contempt matters for failure to pay child support. If you find yourself involved in a child support dispute, call our office right away.
- SEPARATION AGREEMENTS
There are some occasions when a couple would rather settle their divorce issues and have a formal agreement prepared to evidence their agreement, prior to the filing of a divorce suit. A separation agreement is a contract between a married couple who have seriously considered dissolving their marriage and have become separated, but are not yet involved in the divorce process. These agreements often address matters involving child custody, visitation, child support, division of marital property and division of marital debt. Depending on the circumstances, after the filing of the divorce action, a separation agreement can also be incorporated into the final order of divorce.
